James F. Lynch accepts arbitration appointments throughout California. He brings more than thirty years of litigation and claims experience to the neutral’s chair, hears matters promptly, and issues written, well reasoned awards without delay.
Uninsured and Underinsured Motorist Claims
California Insurance Code § 11580.2 et seq. prescribes arbitration as the method for resolving uninsured and underinsured motorist claims. James has worked both sides of the modern UM/UIM landscape: many carriers and insureds now take these disputes to non-statutory mediation, where he has helped the parties reach negotiated settlements, while other carriers adhere to the statutory procedure from the outset. When they do, he administers the hearing, weighs the evidence, applies the policy language and the law, and issues a timely award.
Breach of Warranty
Most breach of warranty arbitrations are automotive Lemon Law claims against the manufacturer under the Song-Beverly Consumer Warranty Act. Many claimants choose arbitration as the more expedient and cost effective forum. James knows these cases from every seat: as an advocate, as a judge pro tem, and as an arbitrator.
Kaiser Medical Malpractice Arbitration
James Lynch is a member of the panel of neutral arbitrators approved by the Office of the Independent Administrator, which administers medical malpractice arbitrations for Kaiser Permanente members under the arbitration provision of the Kaiser coverage contract.
Bodily Injury
James has spent much of his career on bodily injury claims and arbitrates them across the full range:
- Auto versus auto collisions
- Trucking collisions, including rear and side underride incidents resulting in injury or death
- Premises liability
- Injury-producing public nuisance claims
Binding Mediation
“Binding Mediation” refers to a situation in which the parties agree to initially participate in mediation. If the dispute is not resolved through mediation, the matter is then presented for arbitration, with a binding award issued thereafter. Admittedly, this is an infrequently employed method of ADR, but James has, when asked and agreed, been successful in resolving cases in this manner.
